Waiver

RELEASE, WAIVER AND INDEMNITY In consideration of the acceptance of the services to be rendered and the facilities to be made available to me, I, for myself, my heirs, executors, administrators, successors and assigns hereby release, waive and forever discharge the Operator and all its partners, affiliates, employees, contractors, officers, directors, shareholders, agents, representatives, successors and assigns (as applicable) of and from all claims, complaints, demands, damages, liabilities, costs, expenses, actions and causes of action, whether in law or equity (collectively “Claims”) in respect of death, injury, loss or damage to my person or property howsoever caused, which may arise by reason of or during my participation in activities with Pro-Fit Enterprises Inc. / Zullo Health & Fitness, whether or not any claim I have is related, directly or indirectly, to my following any exercise program, and notwithstanding that any Claim I have may have been contributed to or caused by the negligence of the Operator or any of the above-noted persons or critics.

ACKNOWLEDGEMENT OF RISK I hereby acknowledge that it shall be my responsibility to participate in health & fitness programs, training, treatment or classes and to determine my ability to engage in such things or use any particular piece of equipment, or engage in any activity with or sponsored by Pro-Fit Enterprises Inc. / Zullo Health & Fitness, and I do so at my own risk. In this regard, I hereby acknowledge I have been advised by Pro-Fit Enterprises Inc. /Zullo Health & Fitness staff or representatives that I should, prior to starting a new fitness program, or engaging in any activity sponsored by Pro-Fit Enterprises Inc. / Zullo & Fitness, and at reasonable intervals thereafter, to consult with a doctor in order to determine my ability to embark upon any fitness program, training camp, use any particular piece of equipment, or engage in any activity in, or sponsored by, Pro-Fit Enterprises Inc. / Zullo & Fitness. I further acknowledge that my engagement in any activity in, or sponsored by, Pro-Fit Enterprises Inc. / Zullo Health & Fitness is completely voluntary and I am aware of the risks associated with and the possibility of harm arising from such activities. I acknowledge that Phil Zullo, though making every effort to attend sessions booked with him, may from time to time utilize the assistance of his highly qualified team of trainers in his place if his absence is required. I acknowledge that Pro-Fit Enterprises Inc. / Zullo Health & Fitness requires 24 hours notice of cancellation or to reschedule any session/appointment I am unable to attend. I acknowledge that failure to provide 24 hours notice will result in a session being deducted from my package or the full cost of the missed session/appointment being charged to my credit card. I agree to notify team Zullo at info@zhfgroup.com if I need to cancel or reschedule a pre-set session or appointment.


PHOTOGRAPHY AND VIDEO I give consent to Pro-Fit Enterprises Inc. / Zullo Health & Fitness, to share any pictures or videos of me at their facility or at their off-site fitness camps/retreats on their social media accounts, website, or other marketing material. I have read and understood this agreement, and I accept, and will abide by all existing and future Rules and Regulations of Pro-Fit Enterprises Inc. / Zullo Health & Fitness. By any execution of this agreement, I acknowledge that a copy of this agreement will be made available to me upon request. This agreement shall be construed in accordance with the laws of Ontario. The parties agree to diligently do or cause to be done all acts or things and to execute all documents and instruments necessary to implement and carry into effect this Agreement to its full extent.
